VISITOR’S ACKNOWLEDGEMENT OF RISKS
In consideration for participating in the activity and for the services of Sierra Nevada Guides, LLC., its officers, agents, employees, representatives, and stockholders, and all other persons or entities associated with those businesses (hereinafter collectively referred to as “SNG”) I agree as follows:
Although SNG has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, SNG has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. SNG does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks.
The “activity” includes but is not limited to backpacking, camping, hiking, rock climbing, backcountry travel, winter sports including but not limited to cross-country skiing and snowboarding, kayaking, water skiing, wakeboarding, tubing, use of watercraft of all kinds, water crossings and swimming in natural or man-made bodies of water, and travel and instruction associated with these activities (collectively, the “activity”). The activity has associated risks that include, but are not limited to, naturally occurring hazards and dangers of all kinds, including risks posed by animals, insects, reptiles, parasites, and the diseases they may carry and transmit to humans; airborne virus exposure, such as exposure to the novel coronavirus; steep and uneven terrain and trails including rocks, dirt, mud, sand, vegetation, and cliffs; hazards associated with activities and travel on, in, or near water; hazards associated with changes in weather and temperature; hazards associated with or posed by other persons in the area; hazards posed by traveling in darkness or dim light; wildland fire; and rugged terrain conditions. The risks also include hazards and dangers associated with the use of man-made structures, vehicles, transportation, materials, water treatment methods, campsites, stoves, campfires, and all equipment, including misuse, defect, failure, or inadequacy of equipment.
I am aware that injuries may occur far from rescue or medical personnel and that it may take rescue or medical personnel a long time to locate and reach an injured person, or for the injured person to be evacuated and brought to any provider of emergency medical care. I am aware that the activity entails risks of injury or death to any participant. I understand the description of these inherent and other risks is not complete and that other unknown or unanticipated inherent and other risks may result in injury or death. I agree to assume and accept full responsibility for the inherent and other risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent and other risks.
I acknowledge that engaging in this activity may require a degree of skill and knowledge different from other activities and that I have responsibilities as a participant. I acknowledge that the staff of SNG has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent and other risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.
I expressly acknowledge that naturally occurring disease processes (including, but not limited to, coronavirus) occur in all environments in which this activity will take place. I acknowledge that, while SNG has taken reasonable measures to avoid contact, transmittal, or contamination of the virus between people (including guests/participants, employees, and other third parties), that it is ultimately my responsibility to safeguard myself and others.
I understand and agree that, if I choose to participate in this activity, that SNG cannot and will not have any legal liabilities toward me if I contract the virus. On the other hand, if it is determined that I acted negligently or unreasonably and was responsible for transmittal of the coronavirus (or any disease process) to other SNG participants or employees, that I may be held legally and financially responsible for that transmittal.
I have carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children.
